Please read these Terms and Agreements ("Terms") carefully before using the design services ("Services") provided by Monolith Studios ("Company", "we", "our", or "us").
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Services.
All intellectual property rights in and to any copyrighted materials, trademarks, and any other intellectual property rights related to the Services are owned by Monolith Studios unless explicitly stated otherwise.
Unless stated otherwise, all materials created by Monolith Studios for the client ("Client") shall be owned by the Client. Monolith Studios reserves the right to showcase such materials on social media platforms and marketing channels unless otherwise specified in Section 18.
In the event that any project by Monolith Studios incorporates fonts that are not owned by Monolith Studios and require a commercial license for the Client to legally reproduce, distribute, or publicly display the project ("Third-Party Font(s)"), Monolith Studios will inform the Client in writing. This notice will include information sufficient for the Client to identify which licenses are required for the Third-Party Fonts and who to contact to purchase said licenses. As long as Monolith Studios has informed the Client as described above, the Client assumes all responsibility for any consequences resulting from a failure to purchase one or more licenses for any Third-Party Fonts incorporated into a project.
By using our Services, you represent and warrant that you are over the age of 18 and are legally capable of entering into binding contracts.
You may not use the Services for any illegal or unauthorized purposes. Unauthorized reproduction, resale, or distribution of any services provided by Monolith Studios is prohibited.
The Client acknowledges and agrees that any questions, comments, suggestions, or other feedback or submission (each a "Submission") provided to Monolith Studios shall become the sole property of Monolith Studios. Monolith Studios is under no obligation to keep a Submission confidential or take steps necessary to ensure the confidentiality of a Submission. Monolith Studios shall be the sole and exclusive owner of all rights related to the Submission, except to the extent that rights are granted to the Client under Paragraph 2 ("Ownership of Materials"). Monolith Studios shall, at its sole and unrestricted discretion, use and disseminate a Submission for any lawful purpose without permission, acknowledgment, or compensation of or to the Client. The Client agrees that it has the right to articulate and put forth the Submission and hereby waives all claims and recourse against Monolith Studios for its use of the Submission in accordance with the terms hereof and in its sole discretion hereafter.
Monolith Studios retains the right to manage and oversee the provision of Services to ensure compliance with these Terms.
By using our Services, the Client agrees to be bound by our Privacy Policy and the terms more particularly set forth therein. Access to our platform from the EU, Asia, or any other region may result in the application of differing laws regarding data collection and use. Monolith Studios does not knowingly solicit or accept information from individuals under the age of 18.
